DEFINITIONS

  • “Payment Instrument” includes credit card, debit card, bank account, prepaid payment instrument, Unified Payment Interface (UPI), Immediate Payment Service (IMPS), or any other method of payment developed or added by financial institutions from time to time.

  • “Platform” refers to the website or application where the Merchant offers its products/services and where the transaction is initiated.

  • “Transaction” means the order or request placed by the User to purchase the products/services listed on the Platform by paying the Transaction Amount.

  • “Transaction Amount” means the amount paid by the User in connection with a Transaction.

  • “User/Users” means any person availing of the products and/or services on the Platform.

  • “Website” means www.instamojo.com or its mobile application.

MERCHANT’S RIGHTS

You agree that we may collect, store, and share the information you provide to deliver products/services or to contact you regarding the same.

YOUR RESPONSIBILITIES

You agree to provide true, complete, and up-to-date information necessary to complete Transactions. This includes, but is not limited to:

  • Name, email, phone number, delivery address, age, and gender

  • Accurate payment information

PROHIBITED ACTIONS

You may not use the Platform for any unauthorized or unlawful purpose. You agree not to:

  • Retrieve content to compile a database without written permission.

  • Make unauthorized use including scraping user data or creating fake accounts.

  • Circumvent security features.

  • Mislead others or attempt to obtain sensitive data.

  • Abuse support services.

  • Use scripts, bots, or automated systems to interact with the Platform.

  • Impersonate others.

  • Harass, harm, or abuse others.

  • Compete with us using our Platform.

  • Reverse engineer or decompile Platform software.

  • Upload viruses or engage in spamming.

  • Tarnish or harm the Platform’s reputation.

  • Violate applicable laws or regulations.

LIMITATION OF LIABILITY

Your only recourse for defective products/services is to initiate a refund process per these Terms. We disclaim liability for any such losses.

You shall indemnify and hold harmless the Merchant and its affiliates from any claims or damages resulting from your breach of these Terms.

GUIDELINES FOR REVIEWS

When posting reviews, you must:

  • Have firsthand experience.

  • Avoid profanity, hate speech, or discriminatory language.

  • Not reference illegal activity.

  • Not be affiliated with competitors when posting negative reviews.

  • Avoid misleading or false claims.

  • Not organize review campaigns.

We may accept, reject, or remove reviews at our sole discretion. Reviews do not represent our opinions and we assume no liability for them.

By posting a review, you grant us a non-exclusive, worldwide, royalty-free license to use and distribute the content.

GOVERNING LAWS & DISPUTE RESOLUTION

These Terms are governed by the laws of India. Courts in Bengaluru, India shall have exclusive jurisdiction.

Disputes shall be resolved via arbitration under the Arbitration and Conciliation Act, 1996, in English. A sole arbitrator will be appointed by mutual agreement or as per the Act if no agreement is reached within 30 days.

Arbitration shall be confidential. Parties may seek injunctive relief from Bengaluru courts if needed. Arbitration costs will be borne as per the arbitral award.

GRIEVANCE REDRESSAL

For complaints regarding products, services, or Transactions (including double debits, fraud, or refunds), please contact us through the grievance channel provided.

DISCLAIMER

  • By initiating a Transaction, you are entering into a binding agreement with us.

  • You shall pay using legal sources through approved Payment Instruments.

  • We may share your payment details with third parties for fraud verification or if required by law.

  • We disclaim liability for unauthorized payment usage or technical failures.

  • Maintain confidentiality of any user ID, order ID, or password provided.

  • Content on the Platform is for general information only and does not constitute advice.

  • We are not responsible for third-party content or links.

  • User-uploaded content is not verified or approved by us.

  • We do not guarantee the Platform is virus-free—users must use their own protection.
